Judge rejects request to force York pot referendum

Daniel Murphy, a shareholder and member of Bernstein Shur’s Litigation Practice Group, was recently featured in the Portland Press Herald for his role in successfully fending off an emergency request for a Temporary Restraining Order sought against the Town of York. At a hearing held late last week at the York County Superior Court, the Court held that Plaintiffs failed to show a substantial likelihood of prevailing on their claim seeking to place a local marijuana referendum on the ballot for the upcoming November election. Mary Costigan, a member of Bernstein Shur’s Municipal Group, serves as counsel for the Town of York and also assisted in opposition to Plaintiffs’ requests relief.
