Anticipating COVID-19 Litigation Through the Causation Lens
Tara Walker, a member of Bernstein Shur’s Coronavirus Legal Response Team, and Joshua Rosen, a First Year Summer Associate with Bernstein Shur in 2020 have authored an article in Winter edition of the ME Bar Journal. In it, they revisit some of the initial assumptions made about whether COVID-19 would create an avalanche of litigation. They focus on the potential sources of evidence and how infections could be traced between people. They reflect on how public-health agencies’ efforts to fight the virus may aid future plaintiffs and some of the challenges that may lie ahead for plaintiffs’ attorneys
