Join the National Association of Social Workers Maine Chapter for the 2022 Annual Conference taking place October 27 + 28, 2022 where attorneys Kenneth W. Lehman & Benjamin Dexter will be featured speakers during a 3-part session on the legal and ethical issues in behavioral healthcare.

The NASW Maine 2022 Conference is a two-day conference for social workers and allied professionals from around the state.

 

The Evolving Dynamics of a Social Worker’s “Duty to Warn and Protect” in Maine
K. Lehman, Esq. & B. Dexter, Esq.
We will discuss the “Duty to Warn,” including: a detailed analysis of the Tarasoff decision and cases that imposed or did not apply a duty to warn; the NASW Code; Maine’s still applicable 1999 “permissive reporting” health information confidentiality law; HIPAA privacy rules permissive reporting and the “minimum necessary” standard; and Maine’s 2019 law establishing a narrowly crafted mandated duty to warn and protect requirement. Strategies for handling duty to warn situations will be discussed with ample time for Q & A. This session will offer 3 hours of Ethics continuing education.

Legal and Ethical Issues in Behavioral Healthcare – Part 2: Working with Adults

The discussion of current legal and ethical issues within behavioral healthcare continues with this Part 2 session offered by our legal experts from Bernstein Shur. In this session, there will be a focus on those legal and ethical issues that arise when working with adult clients. This session will offer 1.5 hours of Ethics continuing education.
