Bob Keach Receives American Bankruptcy Institute Lifetime Achievement Award

During the annual National Conference of Bankruptcy Judges, the American Bankruptcy Institute (ABI) honored Bernstein Shur Shareholder Robert J. Keach with its 2021 Lifetime Achievement Award. The award is the highest recognition given by the ABI and recognizes the recipient’s sustained and deep commitment to the leadership and governance of the organization.

He has done everything from serving as President of the ABI, co-chairing the ABI’s Commission to Study the Reform of Chapter 11, and publishing articles on bankruptcy and creditors’ rights, to appearing as a panelist on national bankruptcy, lender-liability and creditors’ rights programs.”

New England Innocence Project Spotlights Bernstein Shur as October 2021 Pro Bono Partner

The New England Innocence Project (NEIP) recently highlighted Bernstein Shur in its Pro Bono Partner Spotlight Series for the month of October. Each month, the series highlights the important efforts of law firms who are working to identify and free people who were wrongfully convicted, while exposing systemic flaws in the criminal legal system.

Bernstein Shur Named to List of 2021 Best Places to Work in Maine

Bernstein Shur is proud to announce its achievement as one of the 2021 Best Places to Work in Maine. This award marks the 10th year in which Bernstein Shur has been featured on the list. This statewide survey and awards program was designed to identify, recognize and honor the

Joan Fortin Featured in Mainebiz CEO Breakfast Forum: 60 Ideas in 60 Minutes

On October 20, Bernstein Shur CEO Joan Fortin appeared in the Mainebiz panel, CEO Breakfast Forum: 60 Ideas in 60 Minutes, featuring six of Maine’s leaders in an event to highlight their personal stories of success and learning experiences. Each CEO was invited to share ten ideas that other business leaders can learn from, including ideas about managing people, money, products, and marketing. Fortin’s presentation included topics such as compassion, vulnerability, mental health, and the cultures created within organizations.

Bernstein Shur Hosts 6th Annual Women In Construction Event

The 6th annual Women in Construction event returned for another successful year. The event, hosted by the Construction Practice Group and Shareholder Asha Echeverria, featured presentations from Heather Thompson, Kavya Bhanupriya, and Be Schonewald, who discussed their experiences as women in the construction industry, and the challenges they have faced during their careers. Following the presentations, there was a panel discussion with the presenters moderated by Shareholder Mary Costigan. Approximately one hundred participants, including attorneys from both Maine and New Hampshire, attended the event both virtually and in-person.

Bernstein Shur Investigation Practice Presents to Regional and National Independent School Associations

On October 19, Shareholders Kai McGintee & Talesha Saint-Marc presented to the Association of Independent Schools in New England (AISNE) and the National Association of Independent Schools (NAIS).
At the Association of Independent Schools in New England 2021 DEI Conference, Saint-Marc and McGintee presented on Responding to Racial Bias Complaints, giving an overview of implicit bias, microaggressions, and cultural competency and discussing how those concepts impact a school’s response to bias incidents. McGintee also presented to members of the National Association of Independent Schools concerning the NAIS Trend Report: Investigations of Student and Employee Misconduct, which featured practical advice about common issues that arise in investigations involving student or employee misconduct.

Bernstein Shur Attorneys Published in American Bankruptcy Institute Journal

Bernstein Shur Attorneys Adam Prescott and Kyle D. Smith were recently published in the October 2021 issue of the American Bankruptcy Institute (ABI) Journal. The article, titled Coverage Gap: Rethinking SBRA’s Exclusion of SARE Affiliates, discussed the Small Business Reorganization Act of 2019 and its exclusion of single-asset real estate affiliates from opting into subchapter V of Chapter 11. The article also proposed alternative legislation that would further the goals of the Small Business Reorganization Act while balancing the historic concerns about single-asset real estate debtors.

Shareholders Kat Joyce and Kevan Lee Deckelmann Present in Association of Corporate Counsel (ACC) Webinar

Attorneys Kat Joyce and Kevan Lee Deckelmann presented at a webinar this month in collaboration with the Association of Corporate Counsel New England (ACC), titled “Collaborating & Preparing for the Negotiations”. Lee Deckelmann and Joyce were joined by Kelly Whetstone, Deputy General Counsel at Foreside Financial Group, to discuss the collaborative process between in-house and external counsel in preparing for a critical negotiation in various contexts, including M&A, regulatory applicability and/or approvals and mission critical contracts. Shareholder Paul McDonald will also be participating in an ACC ethics panel on November 17th following the three-part series.

Bernstein Shur Participates in New Hampshire Run for Justice 5K

A team of Bernstein Shur attorneys and staff participated in the inaugural Run for Justice 5k on October 2. Three team members won for their individual age categories, and the group distinguished itself as the largest law firm team at the event. Proceeds from the 2021 Run for Justice support New Hampshire Legal Assistance and 603 Legal Aid in their missions to prevent homelessness, protect survivors of domestic abuse and provide equal access to justice for all.

Bernstein Shur Welcomes Jana Caty & Matt Miller

Bernstein Shur recently welcomed two new attorneys to the firm’s offices in Maine and New Hampshire.
Jana Caty joined Bernstein Shur as an associate attorney in the firm’s Portland office, working with the firm’s Litigation Practice Group. Previously, Caty worked as a litigation attorney at a Portland-based firm handling a wide variety of civil matters throughout the state of Maine. Caty also worked as a Law Clerk for the Maine Superior Court in Bangor, Maine. She is licensed to practice in the state of Maine and resides in Westbrook, Maine.
Matt Miller joined Bernstein Shur as an associate attorney in the firm’s Manchester office, working with the firm’s Litigation Practice Group. Previously, Miller worked as a Law Clerk to Magistrate Judge Andrea Johnstone at the U.S. District Court for the District of New Hampshire. During law school, he served as a Legal Resident in the U.S. Attorney’s Office and in the Environmental Protection Bureau of the N.H. Attorney General’s Office. Before law school, Miller worked in public relations for Vermont’s community college system and in the New Hampshire and Washington offices of U.S. Congresswoman Ann McLane Kuster. He is licensed to practice in the state of New Hampshire and resides in Portsmouth, New Hampshire.

Teresa Rhodes Rosenberger Re-Elected to Board of the New England Council

Bernstein Shur Senior Government Relations Advisor Teresa Rhodes Rosenberger was recently re-elected to the board of the New England Council. The Council is a non-partisan alliance of businesses, academic and health institutions, and public and private organizations throughout New England formed to promote economic growth and a high quality of life in the New England region. As a member of the board, Rosenberger will work closely with Council staff to identify issues and policies in which the Council should be engaged, to shape the council’s policy positions, and to develop high-quality programming for members.
