On March 18, Shareholder Ned Sackman will chair “Best Practices for Civil Discovery in New Hampshire,” a half-day seminar designed to help litigators navigate the evolving challenges of discovery in New Hampshire courts. The program brings together experienced practitioners and members of the bench to share insights on current discovery practices and emerging legal developments. 

As chair, Ned will help guide discussions on key aspects of modern civil discovery, including proportionality, electronically stored information (ESI), and strategies for resolving discovery disputes efficiently. The program will also examine how courts apply both New Hampshire Superior Court Rule 21 and Federal Rule of Civil Procedure 26 in discovery disputes, highlighting common flashpoints and practical approaches to motion practice and attorney cooperation. 

Participants will also explore important ethical considerations surrounding privilege, protective orders, and document preservation. In addition, the program will address recent developments in New Hampshire law, including the evolution of the common interest doctrine following the decision in Atlantic Anesthesia, P.A. v. Osgood
