Bernstein Shur Expands Workplace and Title IX Investigation Resources

Bernstein Shur, one of northern New England’s largest law firms, announced the expansion of its workplace and Title IX investigation resources. Attorneys Naomi Butterfield and Kai McGintee, members of Bernstein Shur’s Labor and Employment Practice Group and Education Law Group, completed specialized training to serve as external neutral investigators for employers and educational institutions.

Butterfield and McGintee attended the National Institute for Workplace Investigators in Oxnard, California, an intensive five-day course in conducting workplace investigations led by the Association of Workplace Investigators, Inc. AWI’s mission is to promote and enhance workplace investigations by providing interactive and comprehensive training. Butterfield and McGintee are members of AWI.

Bernstein Shur has extensive workplace investigation expertise and has provided investigation services to clients in many industries, including for construction companies, banks, retailers, educational institutions and public entities. The team assists clients by providing a prompt, unbiased and thorough investigation and report for the client’s consideration and decision making. Often, the team serves as outside investigators for employers facing alleged discrimination, sexual harassment and civil rights claims.

Attorney Matt Tarasevich, a Bernstein Shur shareholder and co-chair of the Labor and Employment Practice Group, is part of the team which includes attorneys based in both ME and New Hampshire. “We’ve expanded our efforts in workplace investigations to fill the growing need for unbiased and professional investigators,” said Tarasevich. “During any investigation, we strive to provide clear facts and conclusions, meet the employer’s time frames, while clearly outlining the costs of any perceived action.”

Butterfield is based in the firm’s Manchester, New Hampshire office. Her experience representing clients includes preventing and defending disability and discrimination claims including Title IX, administration of personnel policies, FERPA and protection of records, bullying and sexual harassment, contract compliance, and campus and workplace safety. She earned her JD from the University of Denver, Sturm College of Law, and her BS from the University of Michigan.

McGintee is based in the firm’s Portland, ME office. She routinely represents educational institutions and employers and  has litigated cases in state and federal court, and regularly appears before the ME Human Rights Commission, Equal Employment Opportunity Commission and Unemployment Compensation Commission. She earned her JD from the University of Maine School of Law, and her BA from Davidson College.
