Michael A. Hodgins

Mike Hodgins practices in general civil litigation, with a focus on construction claims and other commercial litigation in State and Federal Courts. Mike also manages Bernstein Shur’s Augusta, Maine office.

Mike’s experience in construction litigation includes defense of personal injury and property damage claims, as well as prosecution and defense of mechanic’s liens and other payment claims such as damages for delay, claims for additional work and differing site conditions. His work often includes review and negotiation of construction and supply contracts, as well as resolution of disputes before they rise to the litigation stage. Mike has authored several client articles, and has presented at numerous seminars directed toward the construction industry.

Mike’s general litigation experience includes a wide array of cases, from personal injury to real estate disputes, business dissolution, estate contests and enforcement of non-compete agreements. He represents real estate brokers and agents before the Maine Real Estate Commission and handles several civil litigation matters involving contract or tort claims involving real estate professionals.

Mike also represents towns in contract disputes and other general litigation, land use enforcement actions, Rule 80B appeals to Superior Court and he has participated in several appeals to the Law Court. He has been recognized for distinction in the area of land use and zoning law by Best Lawyers in America, in addition to recognition for his general litigation practice by New England Super Lawyers.

Mike is a trained mediator and has served as a neutral to assist parties in disputes that are as varied as his litigation practice.

Representative Cases

  •  Representation of a business owner in litigation against three insurance agencies/brokers after a building collapse, and determination that the structure was significantly underinsured.
  • Representation of a contractor against the State of Maine in a claim for compensation after a sprinkler failure resulted in significant water damage, and a dispute arose regarding which party was responsible and whose insurance covered the claim.
  • Representation of plaintiffs in the partition of more than 30 acres of coastal island property that had been in the same family for over 100 years, including a four-day trial with more than 20 parties.
  • Representation of the Greater Augusta Utility District at trial and on appeal brought by the City of Hallowell and several residents, successfully defending a significant rate increase required to fund a major construction project for the District.
  • Representation of the Town of Bar Harbor in a four-day trial challenging the Town’s process to enact amendments to the Land Use Ordinance.
