Joshua T. Silver


Josh Silver is a member of Bernstein Shur’s Business Law and Intellectual Property and Technology Practice Groups and co-chair of the Data Security Team.  His practice focuses on technology development and licensing transactions; intellectual property matters; data security; e-commerce; consulting and services arrangements; and a broad range of business transactions.  Since joining the firm in 2006, Josh has represented clients with a wide array of intangible assets and intellectual property and technology related needs.

Representative work includes:

  • Assist software companies in negotiating software licenses, services agreements and source code escrow agreements with large commercial entities.
  • Assist software companies in negotiating reseller and  distributor agreements.
  • Assist companies in negotiating software development and implementation agreements.
  • Assist English and Spanish language telemarketing companies in negotiating services agreements with product marketers for both inbound and outbound telemarketing services.
  • Prepare data security and privacy policies for clients subject to federal and state data security laws and regulations.
  • Assist leading financial services company in negotiating services agreements with data and technology vendors.
  • Assist companies in negotiating patent, trademark, copyright and trade secret licenses.
  • Assist companies in a variety of transactional matters, including sales and acquisitions.

Prior to joining Bernstein Shur, Josh served as a law clerk for the Hon. John A. Woodcock, Jr., U.S. District Court for the District of Maine.  While attending law school, Josh served as a law clerk for the U.S. Attorney’s Office, District of Maine, and as an extern with the Maine Patent Program.
