Bernstein Shur’s litigation practice is broad-based, with representation for both plaintiffs and defendants. The firm is involved in many areas of litigation for domestic and foreign clients, including commercial disputes, securities litigation, antitrust, business torts, taxation, energy, products liability, personal injury, transportation, real estate transactions, education, intellectual property infringement, criminal cases, constitutional issues, health, insurance, environmental matters, and most other general litigation. Our commercial litigation practice includes corporate matters, takeover actions, unfair competition, and contract and construction disputes.

The firm has significant experience with energy, waste, and asbestos-related litigation. Attorneys in the firm are engaged to try cases on a national basis for some clients. We maintain an active insurance defense practice, including life, health, and disability insurance defense. We work extensively in employment-related litigation, including the representation of many clients before the Maine Human Rights Commission. We are active in family business law as well as other litigation where individuals need advice and legal services which are essentially of a private nature.  Some members of the Group have a selective plaintiff's practice, including personal injury and medical malpractice.

Although members of the Litigation Practice are skilled in both jury and non-jury trials, the firm believes strongly in resolving disputes outside the courtroom. We have mediated and arbitrated a wide variety of disputes and conducted mini-trials for management and mock jury trials. Many of our litigators have advanced training as mediators and arbitrators and are often employed as such.
